The agreement,in plain English.

Applied Ego (“Applied Ego,” “we,” “us,” or “our”) is an independent software practice providing design and engineering services and, occasionally, web-based tools or products.

You must be at least 13 years old, or the minimum age required in your jurisdiction, to use the services. If you use them on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

Some features may require an account. You are responsible for keeping your credentials confidential and for all activity under your account. You agree to provide accurate information and keep it current.

You agree not to misuse the services. In particular, you will not:

• Use the services for unlawful, harmful, or fraudulent activity.
• Attempt to gain unauthorized access to systems or accounts.
• Interfere with or disrupt the services, including probing or scanning for vulnerabilities.
• Upload or transmit malware or malicious code.
• Reverse engineer, copy, or resell the services except as permitted by law or written agreement.
• Infringe intellectual property or privacy rights of any third party.

If you submit content to us — messages, files, feedback (“User Content”) — you retain ownership. You grant us a non-exclusive, worldwide, royalty-free license to host, store, reproduce, and display it only as necessary to provide and improve the services, comply with law, and enforce these Terms.

You represent you have the rights needed to provide User Content and that it does not violate any laws.

The services — software, designs, text, graphics, logos, and trademarks — are owned by Applied Ego or its licensors and are protected by intellectual property laws. Except for rights expressly granted in these Terms, no rights are granted to you.

The services may integrate with or link to third-party services such as hosting, analytics, and payment processors. We are not responsible for third-party services, and your use of them may be governed by their separate terms and policies.

By providing your mobile number and opting in — through a web form on this site or verbally when you call or book a service — you agree to receive text messages from Applied Ego related to your inquiries, appointments, and services. Consent is not a condition of any purchase.

• Message frequency. Message frequency varies.
• Rates. Message and data rates may apply.
• Opt out. Reply STOP at any time to stop receiving messages. Reply HELP for help. Every message includes the business name.
• Carriers. Mobile carriers are not liable for delayed or undelivered messages.
• Privacy. Mobile phone numbers are never shared or sold to third parties for marketing. See the Privacy Policy for details on how your information is handled.

If you purchase services, pricing, scope, deliverables, and payment terms will be set out in an order form, proposal, statement of work, or invoice (“Order Terms”). If Order Terms conflict with these Terms, the Order Terms control.

• Fees. You agree to pay fees as described in the applicable Order Terms.
• Taxes. You are responsible for applicable taxes, except taxes based on our income.
• Refunds. Unless required by law or specified in Order Terms, fees are non-refundable once work has started or access has been granted.

Confidential information shared with us — business plans, credentials, non-public data — will be protected with reasonable care and used only to deliver the services. You agree to protect any confidential information you receive from us in the same way.

Parts of the services may be modified, suspended, or discontinued at any time. We try to keep the services available, but we do not guarantee uninterrupted access.

The services are provided “as is” and “as available.” To the maximum extent permitted by law, Applied Ego disclaims all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

To the maximum extent permitted by law, Applied Ego will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, use, goodwill, or other intangible losses.

Total liability for any claim arising out of or relating to the services will not exceed the amount you paid us for the services in the 3 months before the event giving rise to the claim — or $100 if no payment has been made.

You agree to indemnify and hold harmless Applied Ego and its affiliates, officers, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising from your use of the services or your violation of these Terms.

Access may be suspended or terminated at any time if we reasonably believe these Terms have been violated or your use creates risk or legal exposure. You may stop using the services at any time.

These Terms are governed by the laws of the state where Applied Ego is principally located, without regard to conflict of law principles. You agree to exclusive jurisdiction and venue in the courts located there, except where prohibited by law.

These Terms may be updated from time to time. The effective date above will move, and additional notice will be provided when the change is meaningful. Continued use after changes become effective means you accept the updated Terms.
